Cuando un daño tiene origen en una obra municipal, la Administración debe responder. Así lo ha declarado el Juzgado de lo Contencioso-Administrativo nº 21 de Madrid en el procedimiento 167/2024 estimatoria conseguida por nuestro despacho.
El caso afectaba a la Comunidad de Propietarios, que sufrió filtraciones y daños por humedad en los trasteros y acceso al garaje tras unas obras de reparación en la red de riego ejecutadas por la empresa Valoriza Servicios Medioambientales S.A., por encargo del Ayuntamiento de Madrid.
⚖️ La cuestión jurídica
La Administración negaba el nexo causal y atribuía los daños al temporal “Filomena”.
Sin embargo, los informes técnicos del propio Ayuntamiento reconocían que los daños podían deberse a la avería de la red municipal de riego, confirmando así la conexión entre las obras y las filtraciones sufridas.
El Juzgado ha sido contundente:
“Aunque las edificaciones deban mantenerse estancas, ello no exime al causante del daño —en este caso, el Ayuntamiento— de su obligación de repararlo.”
💬 La sentencia
La Sentencia nº 449/2025, de 4 de noviembre, estima íntegramente el recurso interpuesto por la Comunidad y declara la responsabilidad solidaria del Ayuntamiento de Madrid y de Valoriza Servicios Medioambientales S.A., condenándoles al pago de 3.872 euros más intereses legales desde abril de 2022, además de las costas procesales.
Se trata de una resolución firme que ratifica el deber de las Administraciones y sus contratistas de responder por los daños ocasionados durante obras públicas.

Este fallo refuerza una doctrina esencial:
➡️ Los vecinos no deben soportar los daños derivados de actuaciones municipales, incluso cuando las obras sean menores o el Ayuntamiento intente ampararse en normas de mantenimiento o circunstancias meteorológicas.
